soundPATHS agreement and licence

The National Research Council's (NRC) soundPATHS web application is a prediction tool for the calculation of direct and flanking sound transmission between adjacent rooms. The software uses the calculation procedure outlined in the 2020 edition of the National Building Code of Canada.

The soundPATHS application and related publications are derivatives of a series of industry-sponsored research projects conducted at the NRC. The focus and construction details for each phase were decided by a Special Interest Group of technical representatives from each of the supporting partners.

1. Grant of limited licence

   In consideration of the User's acceptance of the terms and conditions of this Agreement, the NRC grants to the User, and the User accepts, a free, non-exclusive, and limited licence to use the Software. This licence granted hereunder is NOT assignable, sub-licensable, or otherwise transferable by the User to any other party either directly or by operation of law.

2. No maintenance support

   The NRC shall be under no obligation whatsoever to provide maintenance or support for the Software; or to notify the User of bug fixes, patches, or upgrades to the Software (if any). If, in its sole discretion, the NRC makes a Software bug fix, patch or upgrade available to the User and the NRC does not separately enter into a written licence agreement with the User relating to such bug fix, patch or upgrade, then it shall be deemed incorporated into the Software and subject to this Agreement.

3. Warranty disclaimer

   The Software is supplied "as is". The NRC disclaims any warranties, expressed, implied, or statutory, of any kind or nature with respect to the Software, including without limitation any warranty of merchantability or fitness for a particular purpose. The NRC shall not be liable in any event for any damages, whether direct or indirect, special or general, consequential or incidental, arising from the use of the Software. The NRC does: (1) not assume any legal liability or responsibility for the accuracy, completeness, or usefulness of the Software, (2) not warrant that the Software will function uninterrupted, that it is error-free or that any errors will be corrected.
